Patna HC Relief to Doctors Who Failed in MBBS exams Over 3 Times, Allows Assistant Professor Applications

Patna: Providing interim relief to the doctors, who failed more than three times in the MBBS examination, the Patna High Court has given them provisional permission to apply for the posts of Assistant Professors in medical colleges.
This order was granted by the division bench of Acting Chief Justice Ashutosh Kumar while considering the plea filed by a doctor, who argued that the advertisement issued by the Bihar Public Service Commission (BPSC) barred such candidates who have failed more than three times during their MBBS studies to be ineligible for the post of Assistant Professor.
While granting the interim relief, the HC bench clarified that the permission was being given to these doctors only as an interim relief, and it would be subject to the final decision of the petition.

As per the latest media report by Jagran, the plea before the HC bench has been filed by Dr. Chakrapani Kumar. Appearing on behalf of the doctor, counsel Advocate Pranav Kumar argued that the rule is unconstitutional as it creates unfair discrimination among candidates.
He submitted that issuing the advertisement for the recruitment of Assistant Professors in the medical colleges across Bihar, the Bihar Public Service Commission (BPSC) mentioned that the candidates who have failed more than three times during their MBBS studies will be considered ineligible for the post of Assistant Professor.
Referring to this, the counsel argued that no such restriction applies to the postgraduate courses like the MD and MS courses. Therefore, the BPSC rule is a violation of the right to equality. He also pointed out that this rule was implemented in the year 2013.
On the other hand, the counsel for the State Government, Advocate General PK Shahi, informed the Court that the Government was ready to review this rule.
Taking note of this submission, the HC bench granted interim relief to the doctors by allowing them to appear in the examination, while clarifying that the relief would be the final outcome of the plea.
The matter has been listed for further hearing on July 03, 2025.
