Kolkata: The Calcutta High Court on Friday rejected an appeal filed by the West Bengal government seeking the death penalty for Sanjay Roy, the convict in the rape and murder case of a PG trainee doctor at RG Kar Medical College and hospital in August 2024.
The Central Bureau of Investigation (CBI) had opposed the state govt's appeal since it had carried out the entire probe and authorised to appeal against the order of the trial court which sentenced Roy to Life Imprisonment, news agency UNI reported.
A Division bench of Justices Debangsu Basak and Md Shabbar Rashid rejected the State government's appeal, which challenged the trial court order pronounced on January 20.
However, a similar petition by the Central Bureau of Investigation (CBI) also seeking the death penalty for Roy has been accepted by the Division Bench of Justice Debangsu Basak and Justice Shabbar Rashidi, reports IANS.

Medical Dialogues had earlier reported that a Sealdah Court sentenced Sanjay Roy to life imprisonment after convicting him for the rape-murder of a female PG trainee doctor at the state-run R G Kar Medical College and Hospital. The court also imposed a fine of Rs 50,000 on the accused.
The court also directed the state to pay a compensation of Rs 17 lakh to the doctor's family. Roy had earlier claimed in court that he was innocent and had been wrongly held guilty.
The trial court sentenced Roy to life imprisonment for the rape and murder of the trainee woman doctor at Kolkata's RG Kar Medical College and Hospital on August 9, 2024.
The trial court noted that the crime could not be classified as "rarest of rare", to award capital punishment to Roy, adds UNI.
Additional Solicitor General (ASG) SV Raju had appeared for the CBI and Advocate General Kishore Datta appeared for the state government.
