Supreme Court rejects Fresh CBI Probe, asks RG Kar Victim's parents to approach HC

New Delhi: Refusing to make any observation, the Supreme Court denied a plea from the parents of the deceased PG trainee, who was allegedly raped and murdered at RG Kar Medical College Hospital, for a fresh investigation by the Central Bureau of Investigation (CBI) into the case.

While hearing the plea, a bench headed by Chief Justice of India (CJI) Sanjiv Khanna directed the grieving family to approach the Calcutta High Court if they wished to pursue further legal action since the CBI’s appeal demanding the death sentence for Roy is currently pending.

As per HT news report, the victim’s parents had moved the apex court, challenging the Sealdah Session court verdict that sentenced the accused, Sanjay Roy, to life imprisonment. In their plea, the parents have sought a further probe to ascertain the alleged role of some other persons. Therefore, they demanded a fresh CBI investigation into their daughter's death.

Dismissing their plea, the single bench further ruled, “Without making any observations, we dispose of the application, granting liberty to the applicant to seek relief from the High Court."

Senior Advocate Karuna Nundi represented the victim’s parents in the Supreme Court, while the Solicitor General of India, Tushar Mehta, argued on behalf of the CBI.

Medical Dialogues had earlier reported that the Calcutta High Court accepted the plea of the Central Bureau of Investigation (CBI) which sought the death penalty for Roy but simultaneously rejected the same plea made by the West Bengal government since state police had carried out the entire probe and also authorised to appeal against the order of the trial court which sentenced Roy to Life Imprisonment.

A Sealdah Court in January this year sentenced Sanjay Roy to life imprisonment after convicting him for the rape-murder of a female PG trainee doctor at the state-run R G Kar Medical College and Hospital. The court also imposed a fine of Rs 50,000 on the accused.

While Roy maintained his innocence in court claiming he was wrongly held guilty, the trial court sentenced Roy to life imprisonment for the rape and murder of the trainee woman doctor at Kolkata's RG Kar Medical College and Hospital on August 9, 2024. The court refused to give him the death penalty as the crime could not be classified as "rarest of rare".

Medical Dialogues had earlier reported that the half-naked body of the deceased RG Kar PG Respiratory Medicine medico was recovered from the seminar hall of the hospital in August 2024. A preliminary autopsy report has indicated sexual abuse before she was killed.

As per the inquest report, there was bleeding from the doctor's eyes and mouth, injury on the face and nails, bleeding from her genitals, and several other injury marks on different parts of her body.

A civic volunteer with the Kolkata Police, Sanjay Roy, was arrested on August 10 by the cops, who identified the accused through a Bluetooth earphone set that was found near the victim's body. An exclusive CCTV footage also showed Sanjay Roy, entering the corridor of the fourth floor of the medical facility moments before the heinous crime.

Soon after the news of this horrific incident came to light, doctors in Bengal and across the country started a massive protest demanding justice for the victim and stronger security arrangements in state-run hospitals.
