PMJAY Beneficiaries Death Case: Khyati Hospital Issued Show Cause Notice for operating without Registration
Ahmedabad: Ahmedabad's Khyati Hospital, embroiled in controversy following the deaths of two patients post-angioplasty, is now under investigation for operating without mandatory registration under The Clinical Establishments (Registration and Regulation) Act, 2010.
Dr Prakash Mehta, Chief District Medical Officer (CDMO) at Sola Civil Hospital, issued a show-cause notice to the hospital on Wednesday stating it is not registered under the Clinical Establishments Act, which is a legal requirement for facilities at this scale. On this, the hospital has been asked to provide a satisfactory response in connection.
While Khyati Hospital was previously registered under the Gujarat Nursing Homes Registration Act, it failed to seek registration under the Clinical Establishments Act when expanding operations in 202 as it is mandatory to function at its current capacity, TOI reports.
Meanwhile, the Gujarat Medical Council (GMC) also probing the incident issued a notice to the hospital on Tuesday and another one on Thursday, demanding an explanation regarding alleged negligence in the treatment of the patients who passed away.
As per the Daily sources, it is claimed that the hospital also had previous lapses which came to light due to the recent shocking death of the two patients. Therefore, the council will investigate all aspects of flouting the norms.
Medical Dialogues had recently reported that one of the two doctors of Khyati Hospital in Bodakdev who were booked for allegedly performing an angioplasty procedure on two PMJAY beneficiaries which led to their death without taking their family's consent was arrested by the city police.
While the cardiologist was apprehended within hours after registering a case, the other doctor facing similar charges is reported to be linked to hospitals in Rajkot and Surat making this a wider controversy.
The arrested doctor is one of five persons accused in three FIRs filed in the case where the owners and doctor of Khyati Multispeciality Hospital were booked for culpable homicide, attempted culpable homicide, forgery, cheating, and criminal conspiracy for allegedly performing unnecessary angioplasty surgeries on two patients who later died due to alleged negligence in post-operative care.
Previously, the Gujarat Medical Council issued a notice to two doctors and three staff of the hospital asking for an explanation of the details in 7 days. The action was taken after families of the deceased patient accused them of medical malpractice and illegally performing the procedure on them by keeping the families in the dark.
The registrar of the council asked the hospital to submit details of all the patients admitted, reasons for admission, treatment given, reports and other relevant documents in seven days for scrutiny. The council also asked for the hospital registration, deed, ownership documents and the registration certificates of the doctors working at the hospital.
