Dr. Saroj Kumar Ghosh to sign statutory certificates of medical device samples: Central Govt
New Delhi: Through a recent gazette notification, the Central Government has authorized Dr. Saroj Kumar Ghosh, Director In-charge of the Central Drugs Laboratory, Kolkata, to sign statutory certificates of test or evaluation of samples of medical devices sent by courts of law under sub-section (4) of section 25 of the Drugs and Cosmetics Act, 1940 or on Form MD-30 of the Medical Devices Rules, 2017,for the whole of India.
This came in exercise of the powers conferred by section 6 of the Drugs and Cosmetics Act, 1940 (23 of 1940) read with clause (a) of sub-rule (1) of rule 19 of the Medical Devices Rules, 2017.
Sub-section (4) of Section 25 of the Drugs and Cosmetics Act, 1940 states, "Unless the sample has already been tested or analysed in the Central Drugs Laboratory, where a person has under sub-section (3) notified his intention of adducing evidence in controversion of a government analyst's report, the Court may, of its own motion or in its discretion at the request either of the complainant or the accused, cause the sample of the drug 3 [or cosmetic] produced before the Magistrate under subsection (4) of section 23 to be sent for test or analysis to the said Laboratory, which shall make the test or analysis and report in writing signed by, or under the authority of, the Director of the Central Drugs Laboratory the result thereof, and such report shall be conclusive evidence of the facts stated therein."
Earlier, the Medical Dialogues Team reported that the Central Government authorized Dr. Saroj Kumar Ghosh, Director In-charge of the Central Drugs Laboratory, Kolkata, to sign statutory certificates of test or analysis on the samples of drugs and cosmetics sent by the Courts of Law under sub-section (4) of section 25 of the said Act or on Form 1 of the Drugs Rules, 1945, for the whole of India.
In continuation, the recently issued gazette notification read,
"In exercise of the powers conferred by section 6 of the Drugs and Cosmetics Act, 1940 (23 of 1940) read with clause (a) of sub-rule (1) of rule 19 of the Medical Devices Rules, 2017, the Central Government hereby authorises Dr. Saroj Kumar Ghosh, Director In-charge of Central Drugs Laboratory, Kolkata, to sign statutory certificates of test or evaluation of samples of medical devices sent by Courts of Law under sub-section (4) of section 25 of the said Act or in Form MD-30 of the Medical Devices Rules, 2017, as the Director In-charge of the said laboratory, for the whole of India with effect from the date of publication of this notification in the Official Gazette till the regularly appointed person takes charge of the post or until further orders, whichever is earlier."
The Central Drugs Laboratory, Kolkata is the national statutory laboratory of the Government of India for quality control of Drugs and Cosmetics and is established under the Indian Drug & Cosmetics Act, 1940.
