Delhi: Whopping Rs 14 lakh Fine on SMALL CLINIC for Violating Biomedical waste rules

New Delhi: In a major penalty, the Delhi Pollution Control Committee (DPCC) has directed a small dental clinic situated in the south Delhi area to pay a penalty of Rs 14.30 Lakh on account of operating without obtaining/ applying for mandatory Authorization under Bio-Medical Waste Management Rules. 2016.
The letter written by the DPCC to the clinic noted that under the law it is mandatory for all healthcare facilities to get registered and also take steps proper handling of Biomedical Waste
"As per the provisions of the Bio-Medical Waste Management Rules. 2016 as amended to date. notified by Ministry of Environment. Forest and Climate Change. Govt. of India. every institution/ Health Care Facility generating bio-medical waste is required to take all steps to ensure that Bio-Medical Waste is handled without any adverse effect to human health and the environment as per the procedure prescribed under the Rules." the letter noted
The letter, in particular, drew attention t0 section 10 of the said rules, whereby every occupier or operator handling the biomedical waste, irrespective of the quantity shall make an application in Form II to the prescribed authority i.e. Delhi Pollution Control Committee in this case. for grant of authorization.
Noting that the said Clinic was operating without obtaining/ applying for mandatory Authorization under Bio-Medical Waste Management Rules. 2016, thus violating the provisions of the said Rules, the DPCC notice iterated Directions of Closure to the dental clinic
Besides the same, DPCC also directed the imposition of Environmental Damage Compensation (EDC) on the defaulters and based on the guidelines developed by CPCB for calculation of the said EDC, pegged the said compensation in case of the clinic at Rs 14,30,400/- (Fourteen Lacs Thirty Thousand Four Hundred only). The letter then directed

Now. therefore. you are hereby directed to deposit Environmental Damages Compensation (EDC) of Rs. Rs 14.30.400/. (Fourteen Lacs Thirty Thousand Four Hundred only) in the office of Delhi Pollution Control Committee in the form of Demand Draft (DD) in favour of Delhi Pollution Control Committee. within 15 days of issuance of this order, failing which the said amount will be recovered as arrears of land revenue without any further reference to you.
"Non- compliance of the above shall be treated as contempt of Hon'ble NGT order(s) and necessary action will be initiated as per the provisions of law," the notice added
