Bengaluru: The Bengaluru bench of Karnataka High Court recently set aside the results of practical examination of 41 MBBS students who had failed and directed the Rajiv Gandhi University of Health Sciences (RGUHS) to conduct fresh practical examination for the medicos within three weeks.
"Respondent – RGUHS is hereby directed to conduct fresh practical examination to the aforementioned petitioners in the subjects mentioned above within a period of three weeks from the date of receipt of certified copy of this order," the HC bench comprising of Justice MI Arun noted.
Such a direction was given by the bench after the University itself decided to conduct fresh examinations and the students also agreed.
The HC bench was considering a bunch of petitions filed by the medical students belonging to RGUHS affiliated institutes. They submitted before the court that they have all succeeded in the theory examination in the final year theory examination of MBBS Course. However, they have failed in practical examination.

While some of the candidates failed in the Surgery subject, some failed in other subjects such as Obstetrics and Gynaecology, Pediatrics, and General Medicine.
The students contended that the practical examination had not been conducted in accordance with law and was done in violation of guidelines issued by the University.
As per the latest media report by
The Hindu, the students argued that they had been awarded less than minimum marks required in the practical examinations because of "personal bias" towards them by some of the faculty members. They also claimed that the external evaluators also failed to evaluate the papers in the prescribed manner.
On such grounds, the students prayed that their results in so far as practical examination should be set aside and the University should be directed to conduct a fresh practical examination for the petitioners for the concerned subjects.
When the matter was being considered by the court the counsel appearing for RGUHS submitted upon instructions that taking into consideration the interest of the students, the University has decided to conduct fresh practical examinations for the petitioner candidates, without going into the fact whether practical examination has been conducted in accordance with law or not.
Meanwhile, the counsel for the students submitted that the petitioners were willing to take practical examination in any place as determined by RGUHS.
Therefore, the court set aside the results of the practical examination of the said candidates and ordered, "Respondent – RGUHS is hereby directed to conduct fresh practical examination to the aforementioned petitioners in the subjects mentioned above within a period of three weeks from the date of receipt of certified copy of this order."
