HC dismisses plea by MBBS students praying to appear in examination despite attendance shortfall

Hyderabad: The Telangana High Court bench recently dismissed the pleas by three MBBS students who had not been allowed to appear in the MBBS examinations as they could not fulfil the attendance requirements.

While the students claimed that they had met the requirements regarding attendance, the Kamineni Institute of Medical Sciences and Kaloji Narayana Rao University of Health Sciences submitted that the college had both manual and biometric processes in place and the students did not meet the prescribed attendance requirement.

The petitions had been filed by V. Reethika Reddy and two other MBBS students who had not been allowed to appear in the MBBS examinations because of shortfall of attendance.

However, the petitioner students from Kamineni Institute of Medical Sciences claimed in the plea that the college and the Kaloji Narayana Rao University of Health Sciences were not permitting them to appear in the examination which are scheduled from 21.02.2023 to 06.03.2023.

Claiming it to be illegal and in violation of principles of Natural Justice and the guidelines and norms laid down for determining the attendance eligibility, the students prayed before the HC bench for directing the University and the college for opening the examination fees paying link and allow them to pay the fees for all the papers of Final MBBS Part II regular examinations and allow them to appear in the test.

Previously, while considering the matter, the HC bench had directed the college to show cause on or before 03.02.2023 and posted the matter for further hearing on February 3, 2023.

The counsel for the petitioner student, P Venkata Subbarao had claimed that even though the students had met the attendance requirement, they were not allowed to appear in the exam.

As per the latest media report by Deccan Chronicle, around 60 students are not only falling short of the 75 per cent attendance but also the 10% margin given by the University. 

On the other hand, the college and the University referred to the fact that the college had both manual and biometric processes in place and submitted before the HC bench that the students did not satisfy the prescribed attendance requirement.

Taking note of this, the HC bench dismissed the petitions filed by the MBBS students.
