Impersonation in MBBS exams: Patna HC denies relief to student, seeks response from authorities

Patna: The Patna High Court recently denied interim relief to an MBBS student accused of arranging for another person to appear on his behalf in a third-year medical examination. The case pertains to impersonation in internal exams by four medicos in Govt Medical College, Bettiah. The court took judicial notice of an FIR lodged against four students of Govt Medical College, Bettiah, on whose behalf four other students of different medical colleges of Bihar, including Indira Gandhi Institute of Medical Sciences (IGIMS), took the internal exam.
The court noted the seriousness of the impersonation charge, with government counsel highlighting the threat such actions pose to public health.
The court directed the Vice Chancellor of Aryabhatta Knowledge University to file a reply by the next hearing scheduled for June 20, 2025, after noting the absence of the university’s legal representation. Meanwhile, Bihar’s Health Department has been asked to ensure the university’s compliance. An FIR has been registered against the student by the university’s Examination Controller, while similar cases involving other students had earlier seen relief due to procedural delays from the university.
As per the UNI report, the Patna High Court on Monday refused to grant any interim relief to Kumar, a student of MBBS of Government Medical College, Bettiah facing the charge of arranging for another student to appear on his behalf in the third-year examination of the College.
Justice Parthasarti of the Court, while hearing a petition of Kumar, refused to entertain his plea of granting relief. With this, the Court accepted the plea of government pleader Prashant Pratap that impersonation was a serious issue and Arbind did not deserve any mercy as it could pose a serious threat to public health security.
" New generation of the society will suffer the most in medical care if such a student who himself can not clear the examination and arrange for another student to appear on his behalf in third year MBBS examination of the medical college ", Pratap pointed out and added that petitioner himself had admitted in his petition that he had utilised the services of another student to appear on his behalf in the examination of third year of ENT.
"Such impersonation in a medical examination is not only a crime rather a grave threat for society as a whole, because quality doctors are a fulcrum for safeguarding the life and living system of human beings," Pratap added, reports TOI.
On the other hand, Ramchandra Singh, counsel of the petitioner, urged the Court to allow Arbind to appear in the next examination for MBBS. He pleaded that some students of the Medical College were granted relief in a similar case, as Aryabhatta Knowledge University had not filed its reply in the case.
The Court directed the Vice Chancellor of Aryabhatta Knowledge University to file a reply in the case and fixed June 20, 2025, as the next date of hearing. The Court also directed the Additional Chief Secretary of the Health Department of the Bihar government to inform the Vice Chancellor of the University to file a reply in the case, as counsel for the University was not present in the Court, adds UNI
Admission of four students was cancelled by the College in the same case, but they got relief as Aryabhatta Knowledge University had failed to reply in the case. An FIR was filed against Arvind by the Examination Controller of the University for arranging for another student to appear on his behalf in third third-year examination of ENT of the college.
