Mumbai: MBBS Doctor arrested for allegedly operating on piles patient without MS degree

In fact, the accused has confessed before the Police to have performed thousands of such surgeries on other patients as well. Finally, the Police registered a case against the doctor on Monday after both Maharashtra Medical Council (MMC) and the expert panel from JJ Hospital confirmed the negligence on the part of the accused doctor.

According to recent media accounts, the doctor, who claimed to have completed his graduation in medical education in 2017 from a University in Andhra Pradesh has been arrested under sections 337 (Causing hurt by act endangering life or the personal safety of others), 419 (cheating by personation) and 420 (cheating) of the Indian Penal Code (IPC).

Police came to know about the incident when a 46-year-old patient, who is a taxi-driver by profession, approached the Police and claimed that the accused doctor allegedly performed piles surgery on him and endangered his life.

As per the latest media report by the Indian Express, the patient had found the doctor's number on the internet. In fact, the Police have informed the daily that the doctor had been running a clinic in Dadar for the past three years and even advertised about the clinic by putting up hoardings across the city. The posters claimed "100% treatment without operation."

Hindustan Times adds that the website of the clinic allegedly claimed that it was the first clinic in Mumbai to introduce non-operative or non-surgical treatment for piles, fissure ad fistula.

When the complainant, who was suffering from Piles for the past three years, visited the doctor's clinic back on February 20, the doctor allegedly told him about the necessity of conducting a small surgery. The surgery was conducted on February 21 and the patient was allowed to go home after four hours.

An officer from Matunga Police Station told Indian Express, "The complainant was made to fill a consent form after which the doctor performed a surgery on him. He was charged Rs 25,000 for the operation."

"He later experienced excessive bleeding from his anal region, leading to unconsciousness. His wife took him to KEM Hospital in Parel, where doctors informed him that the surgery performed on him, was done in wrongful and negligent manner," a police officer told HT.

After getting discharged from the hospital, the complainant approached the Police and lodged a complaint regarding the matter on March 5. Following this, the police wrote to the MMC and JJ hospital for their expert opinion regarding the matter.

"The council reverted a month back stating that an MBBS doctor cannot perform any surgery until he has a Master in Surgery degree," an investigator told Indian Express. "At the same time, a special panel appointed at JJ hospital to probe the matter gave us a report on June 20 confirming negligence on the part of the doctor," the officer added.

Following this, the Matunga Police registered a case against the doctor and arrested him under relevant sections of the Indian Penal Code. The doctor was produced in Court on Wednesday and the Court has remanded him to Police custody till June 27.

Police are trying to track other patients who were treated and operated on by the accused doctor previously and also planning to approach the university in Andhra Pradesh seeking confirmation on his MBBS qualification.

Meanwhile, talking to HT, the complainant said, "Because of the faulty surgery, I cannot work as a driver. I had joined a private company, but due to my piles-related complications, they sacked me in three days."

While commenting on the matter, Dr. Shivkumar Utture, President of Maharashtra Medical Council, told Indian Express, "Until an MBBS doctor is qualified, they are not authorized to perform any surgery."
