Korba: Three doctors, including a government surgeon, have been booked under IPC 304A (causing death by negligence) and 34 (common intention) after a five-year-old boy died during hernia surgery in Chhattisgarh's Korba district allegedly due to the medical practitioners' negligence.

An FIR has been registered against the three doctors, however, no arrest has been made so far and police are conducting an investigation into the case, officials said on Tuesday.

Notably, medical negligence cases are to be booked under IPC Section 304A (Causing death by negligence) as per various high court and supreme court judgments on medical negligence.

The district Chief Medical and Health Officer (CMHO) has also been asked to constitute a team of senior doctors to conduct a probe into the case and submit a report, Korba's Additional Superintendent of Police Kirtan Rathore told PTI.

As per a police complaint lodged by the boy's father, who is a laborer from Belgari Basti locality here, he had taken his son to the district hospital on January 6 where a surgeon told him that the child was suffering from a hernia, and advised a sonography test.

Later, the surgeon told them that the child required urgent surgery and decided to conduct the operation at a private hospital here, citing that the government hospital lacks adequate facilities, station house officer of Balco police station, Rakesh Mishra, said quoting the complaint.

On January 9, during the operation, being performed by the surgeon and one other doctor at the private hospital, when the man asked the surgeon about his son's health condition, the doctor said the child had stopped breathing. Another doctor was also present there, the official said.

The boy's father in his complaint alleged that later, without consulting him, they shifted the child to another private hospital where doctors said the child was brought in a serious condition and died.

He accused the three doctors of negligence and causing the death of his child, the police official said.

An FIR was registered against the three doctors on Sunday under Indian Penal Code Sections 304-A (causing death by negligence) and 34 (common intention), he said.

No arrest has been made so far and further action will be taken after a probe into the case, he said.

When contacted, the district hospital's surgeon refused to comment on the matter.
