Bhubaneswar: The National Human Rights Commission (NHRC) has sought a complete report on the allegation of medical negligence, irregularities and poor administration at MKCG Medical College and Hospital in Odisha. 

The NHRC issued the reminder to the Principal Secretary, Department of Health and Family Welfare, Odisha government, District Magistrate, Berhampur and Superintendent of Police, Berhampur to file an additional report in light of the complainant's comments, within four weeks.

The Commission in its order passed on September 25 said it would be constrained to invoke its coercive powers u/s 13 of PHR Act. 1993 if the persons concerned failed to submit the complete report within four weeks Petitioner Rabindra Kumar Mishra, a right activist had alleged before the commission that on September 20 last year patient care was adversely affected for over four hours in several wards of that hospital following a clash between house surgeons and nursing staff over examination of a patient in the casualty department.

He alleged that the mutilated body of one admitted patient Anant Rout, a farmer of Pitatali area in Ganjam district was found in the drain of the hospital.

Mishra also alleged that deaths have also been reported on previous occasions due to the fall of the ceiling and said that the right to health, right to live with dignity and right to Life guaranteed under Article 21 of the Constitution of India has been violated.

He had sought the intervention of the Commission in the matter.

In the light of complaint, the commission had called for additional report in July last and in pursuant to same various communications received including a letter of September 8 last from Under Secretary, Department of Health and Family Welfare addressed to Superintendent, MKCG Medical College and Hospital.

However, no actual report is submitted, taking complainant comments into account.

The commission issued a fresh reminder to the officials for filing of additional report in light of complainant comments within four weeks failing which this Commission will be constrained to invoke its coercive powers u/s 13 of PHR Act. 1993.

The NHRC further stated that the additional/complete report as directed by the Commission in the matter be sent latest by November 2 next for futher consideration by the Commission.

It also said any communication by public authorities in this matter may please be sent to the Commission through the HRCNet Portal (https://hrcnet.nic.in) by using id and password already provided to the public authorities.
