Health Ministry Gazette spells out remuneration of NMC officials

New Delhi: Through a recent gazette notification, the Ministry of Health and Family Welfare (MoHFW) has spelt out the remuneration for the Secretary as well as the deputation of the President, Chairperson, Members and Secretary to the National Medical Commission, who may be in service of the Centre or a State or UT Administration.

In addition, a few amendments have been made to the National Medical Commission, Autonomous Boards (Manner of Appointment of Fourth Member and the Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements of President and Members) Rules, 2019; hence transforming the rules to National Medical Commission (Manner of Appointment and Nomination of Members, their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements) Amendment Rules, 2021, mandated to be enforced from 25th September 2020.

The recent amendment relating to the remuneration has been made to sub-rule (1) of Rule 13. Rule 13 entails the qualifications and remuneration of the Secretary to the NMC.

Sub-rule (1) clearly states: "The salary payable to the Secretary to the Commission shall be equivalent to the salary of Additional Secretary to the Government of India in Level 15 in the pay matrix (Rs. 182200-224100/-).

Provided that where the Secretary to the Commission is a retired person from Government, semi-Government agencies, public sector undertakings or recognised research institutions, the salary payable together with the pension or pensionary value of the terminal benefits, or both, received by him shall not exceed the last pay drawn."

After subrule 1, the following amendment has been inserted, as per the gazette notification:

"(1A) If the Secretary to the Commission is in service of the Central Government or a State Government or Union territory Administration, his salary and allowances shall be regulated in accordance with the rules applicable to him or sub-rule (1), whichever is higher."

Moreover, the appointment of President or a whole-time Member, Chairperson (who are in autonomous boards) or Secretary who is in the service of the Central Government or a State Government or Union territory Administration, will now be considered as a deputation, according to the other amendments added to the rules.

In subrule 1 A mentioned above, the following explanation has been inserted:

"For the purposes of this sub-rule, it is clarified that where the Secretary is in the service of the Central Government or a State Government or Union territory Administration, his appointment in the Commission shall be treated as deputation."

In rule 4, in subrule (2) which deals with the appointment of Chairperson and Members of Commission, the following explanation has been added:

For the purposes of this sub-rule, it is clarified that where the President or a whole-time Member is in the service of the Central Government or a State Government or Union territory Administration, his appointment in Autonomous Boards shall be treated as deputation."

Further, in rule 5, in sub-rule (2) which pertains to service of the Chairperson of the Commission, the following explanation has been added as an amendment:

"For the purposes of this sub-rule, it is clarified that where, the Chairperson is in the service of the Central Government or a State Government or Union territory Administration, his appointment in the Commission shall be treated as deputation."
