NMC directs compliance with online appeals filing, explains 1st, 2nd appeal process for doctors against state medical councils, EMRB decisions

New Delhi: The National Medical Commission (NMC) has directed all medical colleges, institutions and Registered Medical Practitioners (RMPs) to file appeals exclusively through its Online Appeal Portal.
Medical Colleges/Institutions may file appeals against decisions of the Medical Assessment and Rating Board (MARB), Undergraduate Medical Education Board (UGMEB), Postgraduate Medical Education Board (PGMEB) and RMPs may file First Appeals before EMRB against decisions of State Medical Councils.
Addressed to all Dean/Principal of all Medical Colleges/Institutions and all concerned Registered Medical Practitioners (RMPs), the NMC has reiterated the operationalisation of its Online Appeal Portal for filing appeals under the National Medical Commission Act, 2019.
The Commission has developed a dedicated online portal for medical colleges and institutions to file appeals against decisions of MARB, UGMEB and PGMEB under the relevant provisions of the National Medical Commission Act, 2019 and the regulations framed thereunder.
Issuing a public notice in this regard on November 4, 2026, Dr Raghav Langer, Secretary of the NMC, referred to the earlier public notices dated July 1 and July 23, 2026, regarding the filing of appeals under the Act.
"Attention of all Medical Colleges/Institutions and Registered Medical Practitioners (RMPs) is invited to the Public Notices dated 01.07.2026 and 23.07.2026 regarding filing of appeals under the National Medical Commission Act, 2019. The following is informed for compliance by all concerned," the notice specified.
The Commission clarified that, with effect from its public notice dated July 1, 2026, medical colleges and institutions must file such appeals of MARB/UGMEB/PGMEB under the relevant provisions of the National Medical Commission Act, 2019 and the Regulations exclusively through the online portal. The facility to submit appeals through email or any other mode has been discontinued.
Similarly, the Apex Medical Commission, in its notice, also stated that under Section 30(3) of the National Medical Commission Act, 2019, RMPs can file a first appeal before the EMRB against decisions of State Medical Councils and under Section 30(4) of the Act, they can file a second appeal before the NMC against decisions of the EMRB.
"RMPs may file First Appeals before EMRB against decisions of State Medical Councils under Section 30(3) and Second Appeals before NMC against decisions of EMRB under Section 30(4) of the National Medical Commission Act, 2019 through the Online Appeal Portal by creating their respective profiles," the notice added.
The Commission has also clarified that RMPs whose first appeals were processed through the physical mode can file their second appeals online by selecting the "2nd Appeal against EMRB decision" option in their login profiles.
Directing all medical colleges and institutions to follow these directions, the NMC said, "All appellants are advised to carefully select the applicable provision and upload all requisite documents. Appellants are further advised to read the terms and conditions and User Manual available on the portal before filing an appeal, to avoid deficiencies. All appeals covered by this Public Notice shall be filed through the respective Online Appeal Portal links specified above, subject to the applicable provisions of the National Medical Commission Act, 2019. The Public Notices dated 01.07.2026 and 23.07.2026 shall be read accordingly,"
HOW TO FILE A 1st APPEAL BY REGISTERED MEDICAL PRACTITIONERS (RMPs)
Step 1: Open EMRB New Appeal
Log in to the NMC Online Appeal Portal and navigate to Appeals > EMRB New Appeal to initiate a First Appeal before the Ethics and Medical Registration Board (EMRB).
Step 2: Read the terms and conditions
Read all the instructions carefully before proceeding. The portal identifies the appeal as a First Appeal before the Ethics and Medical Registration Board (EMRB) under Section 30(3) of the National Medical Commission Act, 2019. The displayed limitation period is 60 days and the appeal fee is ₹590 (inclusive of GST). After reviewing the instructions, click “I Accept & Proceed to Fill Form”.
Step 3: Review personal details and address
The form begins with the “Personal Details & Address” section. Fields with a grey background are auto-fetched from the RMP’s registration and cannot be edited. Review the details displayed, including the full name, mobile number and email address, and proceed after ensuring that the information is correct.
Step 4: Continue through the appeal form
Proceed through the form and complete all applicable fields. Check the information entered for accuracy and provide the details and documents requested by the portal. Ensure that uploaded documents are legible and complete.
Step 5: Review the fee and complete the pre-submission declaration
Proceed to the fee section and answer the question regarding whether you belong to a Below Poverty Line (BPL) category, as applicable. Review the fee summary displayed by the portal. The portal shows an appeal fee of ₹590, inclusive of GST, with payment to be collected after submission. Read the Pre-Submission Declaration and tick the checkbox to affirm that the information provided is true to the best of your knowledge and belief and that nothing has been concealed.
Step 6: Submit the appeal and pay the fee
After verifying the details and completing the declaration, click “Submit & Proceed to Payment”. Complete the payment as directed by the portal and retain the application details and payment acknowledgement for future reference.
HOW TO FILE A 2nd APPEAL BY REGISTERED MEDICAL PRACTITIONERS (RMPs)
Step 1: Open the EMRB Appeals dashboard
Log in to the NMC portal and navigate to Appeals > EMRB My Appeals. The dashboard displays separate sections for First Appeals and Second Appeals, along with application-status summaries. Select “2nd Appeal to NMC against EMRB decision” from the menu to initiate a Second Appeal.
Step 2: Read the instructions for filing a second appeal
Review the instructions carefully before proceeding. The portal identifies the Second Appeal as an appeal to the Commission under Section 30(4) of the National Medical Commission Act, 2019. The displayed limitation period is 60 days from communication of the EMRB decision, and the appeal fee shown is ₹5,000 plus 18% GST (total ₹5,900). An affidavit in the prescribed format is required with the appeal. After reviewing the instructions and downloading the affidavit format, click “I Accept & Proceed to Fill Form”.
Step 3: Select the mode of filing the first appeal
The portal asks whether the first EMRB appeal was filed online through the NMC portal or offline/physically. Select the applicable option. If the first appeal was filed online, the portal may identify an eligible first appeal linked to the account. If it was filed offline/physically or was not filed on the portal, select “Offline (Filed Physically / Not on Portal)” and fill in the first appeal details manually. If the online option is disabled or no eligible appeal is found, proceed using the applicable offline option.
Step 4: Complete the Second Appeal form
For an offline/physical First Appeal, the portal indicates that the appellant must provide the EMRB order details and upload the order document. Complete the current address and all other mandatory fields, and ensure that the details entered are accurate and the uploaded documents are legible and complete.
Step 5: Submit the appeal and pay the fee
Follow the remaining on-screen instructions to complete and submit the application. The portal displays a Second Appeal fee of ₹5,900 (inclusive of GST), payable after submission. Retain the application number, submitted application details and payment acknowledgement for future reference.
