HC upholds Tamil Nadu homeopathy registration renewal process

Madurai: The Madurai Bench of the Madras High Court has dismissed a petition challenging a notification issued by the Tamil Nadu Homeopathy Medical Council for the renewal of registration certificates, after the petitioner alleged that the notification was issued by an improperly constituted committee.

The petition was filed by GP Hahnemann, a homeopathy practitioner and former member of the council, who challenged a notification dated September 23, 2025. The notification invited applications from homeopathy doctors for renewal of their registration certificates.

The petitioner argued that although the notification claimed it was issued based on a decision of the council’s executive committee, no properly elected executive committee was in place at the time. According to him, the decision was taken by an ad hoc committee made up of nominated members, which he said had no authority to issue such a notification.

Opposing this claim, the division bench comprising Justices G Jayachandran and KK Ramakrishnan stated that the election of executive committee members can take place only after an updated list of registered homeopathy practitioners is prepared.

The court noted that the renewal process was initiated to comply with Regulation 9 of the National Commission for Homeopathy Regulations, 2022, which mandates updation of the details of the licence in the state or national register every five years to avoid penalty and cancellation of registrations.

The court held that the ad hoc committee was legally competent to take steps to prepare and maintain the register of eligible practitioners, as permitted under the National Commission for Homeopathy Act.

"The ad hoc committee, which has now taken the decision to prepare and maintain the eligible registered practitioners of homeopathy is in consonance with the provisions of National Commission for Homoeopathy Act," said the court as reported by the Indian Express.

With these observations, the High Court dismissed the petition and allowed the registration renewal process to continue.
