MP High Court Orders Action Against Doctors for Forging Disability Certificates in Accident Claims

Bhopal/Jabalpur: In a hearing related to motor accident insurance claims case, the Madhya Pradesh High Court has directed the formation of a Special Investigation Team (SIT) to probe fraudulent claims filed through the collusion of claimants, police officers, regional officials, and medical professionals.
The bench, headed by Justice Vivek Agarwal, acknowledged that such fraudulent activities were occurring on a large scale, undermining the credibility of the justice system and causing widespread concern.

The order came after the insurance company had appealed against a decision made by the Jabalpur Accident Claim Court to increase the quantum of compensation for a claimant from Chhindwara. The company claimed that the claimant had submitted a "fake" disability certificate from Victoria Hospital in Jabalpur as part of his claim. The claimant himself admitted that he had never received treatment or been admitted to Victoria Hospital, raising further suspicions about the authenticity of his claim.
Upon further investigation, the court found that two doctors, one from Victoria Hospital and another from Suvidha Hospital, had issued the fake disability certificates for the claimant. These fraudulent documents were used to substantiate his claims and demand a higher compensation than what was due.

Advocate Rakesh Jain represented the insurance company during the proceedings, arguing that the fraudulent practices had not only caused financial harm to the insurer but also tarnished the credibility of the judicial process.
