FIR lodged against doctor for not paying rent of hospital amounting to Rs 55 lakh
Ahmedabad: An FIR has been lodged by the landlord against a doctor who rented a building and later opened a hospital, on grounds of not paying the rent amounting to Rs 55 lakh. A case of breach of trust and cheating has been registered by Maninagar police and the police have already begun an investigation.
The complainant stated in his FIR that the doctor had rented two shops measuring 4,200 square meters near Aavkar Hall to establish a hospital. The hospital was opened by five persons in partnership in 2015, reports Times of India.
In the rental agreement, it was clearly mentioned that the monthly rent would be Rs.s 1.71 lakh. It was further added that there should be a 10% increase in the amount of rent each year. All the five people involved in establishing the hospital agreed on the terms and signed the agreement with the complainant. The hospital at the time of its establishment was named Aavkar Multi-Specialty Hospital and this name was only mentioned in the agreement.
The five people were Harsh Pathak, Hitesh Misharia, Sandip Shah, Gagji Dhamelia, and Mehul Panchal who signed the agreement with the landlord.
However, later the name of the hospital was changed and the owner stopped paying the rent in 2018. The rent was due for almost four years and he is yet to get a rent of Rs 1.02 crore from the other party. The complainant claimed that when he demanded the rent from the doctor, he was informed that the rest of his partners have left the hospital and he is running the facility alone.
According to the daily, the doctor had arranged some money and paid Rs 47 lakh of the total due rent in 2019. However, the remaining Rs 55 lakh is yet to be paid by the doctor. the complainant pointed out that non-payment of rent for so long is a clear breach of the agreement by default.
