HC Stays MPPSC job Notification over allegations of arbitrary selection process for medical officers

Bhopal: In response to a grievance filed against the arbitrary process of selecting medical officers by the Madhya Pradesh Public Service Commission (MPPSC) in the state, the Madhya Pradesh High Court stayed the notification issued by the MPPSC on the interview process for the selection of the candidates.

A single judge bench of Justice S.A Dharmadhikari passed the judgment on a petition filed by Dr. Sharma and others. The petitioners questioned the 'selection process' according to which the MPPSC had decided to conduct an interview of 100 marks and only kept the written examination as an additional option if necessary for selecting medical officers.

Expressing their grievance, the counsel submitted that the selection cannot be made only on the basis of an interview without any written examination which they believed violated a fundamental right, article 14 of the Indian constitution. They further relied on a judgment of a constitution bench of the Supreme Court in Ajay Hasia Vs. Khalid Mujib Sehravardi and others. The petitioners also contended that the intent of this petition and their chances of getting selected would be frustrated if the interviews are to begin from 27th September, 2021 as per the notification which was issued by the MPPSC on 14th June, 2021 for the appointment of medical officers, reports Livelaw

Thus, postponing the selection process for the medical officers in the state of Madhya Pradesh, the court stayed the notification issued by the MPPCS till the next date of hearing, which is, September 30, 2021. According to the notification, the interviews were to be originally held from 27th September, 2021 to 11th November, 2021. The court in its judgement noted,

"Meanwhile, further proceedings in pursuance of notification dated 17/9/2021 (Annexure P/5) of holding interviews w.e.f. 27/9/2021 till 11/11/2021, shall be kept in abeyance till the next date of hearing"

The respondents were issued notice and granted the time period of six days to file a reply.
