NMC slaps Rs 1 crore penalty each on 7 medical colleges for not disclosing MBBS intern, PG resident stipend details

New Delhi: Taking strict action over non-compliance, the National Medical Commission (NMC) has imposed a penalty of Rs 1 crore each on seven medical colleges for failing to disclose information regarding payment of stipends to MBBS interns and postgraduate medical residents.

The colleges on which the penalty has been imposed include Akash Institute of Medical Sciences and Research Centre, Devanahalli, Karnataka, Dumka Medical College, Jharkhand, Government Medical College Barmer, Rajasthan, Government Medical College Ongole, Andhra Pradesh, RKDF Medical College Hospital and Research Centre, Bhopal, Madhya Pradesh, Prasad Institute of Medical Sciences, Lucknow, Uttar Pradesh and Pt. B. D. Sharma Postgraduate Institute of Medical Sciences, Rohtak, Haryana.

In a notice issued by the Under-Graduate Medical Education Board (UGMEB) of NMC dated 12.3.2026, the Commission stated that earlier it had directed all medical colleges and institutions across the country to publish details of stipends paid to interns and PG residents on their official websites to ensure transparency and uniformity in stipend payment.

The directive was issued in compliance with court orders in the cases of State of Uttar Pradesh & Ors vs Miss Bhavna Tiwari & Ors and Abhishek Yadav & Ors vs Army College of Medical Sciences & Ors.

"That in compliance of the Court orders in the cases of State of Uttar Pradesh & Ors. vs. Miss Bhavna Tiwari&Ors.( SLP (C) No. 9298 of 2018), and the Abhishek Yadav &Ors. vs. Army College of Medical Sciences & Ors (WP(C) No. 730 of 2022), the National Medical Commission (NMC), issued Public Notice dated 11.07.2025, directing all medical colleges and institutions across the country to disclose on their official websites the stipend being paid to MBBS interns and postgraduate medical residents, as mandated under the applicable Regulations, and to ensure transparency and uniformity in the payment of stipend," mentioned the notice. 

Despite the aforesaid directions and the adequate time provided for compliance, NMC observed that some medical institutions have failed to comply with the above-mentioned directions.

However, after duly examining the data, the Apex Medical Education observed that seven medical colleges failed to furnish the required information regarding stipend payment despite repeated reminders.

According to the NMC, failure to provide the required information constitutes a violation of the directions issued by the NMC and amounts to non-compliance with the regulatory obligations prescribed under the National Medical Commission Act, 2019, and the relevant Regulations framed thereunder. 

"The non-compliance with the above-mentioned requirements attracts regulatory actions under Clauses 30 and 31 of the Establishment of Medical Institutions, Assessment and Rating Regulations,2D23; Clause 9.2 of the PGMER, 2023; and Clause 8 of the Maintenance of Standards of Medical Education Regulations, 2023," NMC stated in the notice.

The notice further added, "That a penalty of 1,00,00,000 (Rupees One Crore only) is hereby imposed by the National Medical Commission on each defaulting college in accordance with the aforesaid regulatory provisions."

The Commission views the aforesaid non-compliance as a serious and material breach, particularly in light of the directions issued by the Hon'ble Supreme Court of India, mandating the payment of stipend to medical interns and residents.

"The continuing non-compliance with the mandate regarding payment of stipend and disclosure of the same on the institution's websites shall attract further regulatory and penal actions, including but not limited to restrictions on admissions, suspension of permissions, or other disciplinary measures as deemed appropriate by the Commission," read the notice. 

Referring to the UGMEB notice, the Apex Medical Commission issued a notice on 13.3.2026, addressed to the Departments of Medical Education and Directorates of Medical Education of all States and Union Territories, among others.

The notice stated, "Reference is invited to Public Notice No. U-22370-Legal-UGMEB (e-8327699) dated 12-03- 2026 [copy enclosed] issued by the Under-Graduate Medical Education Board (UGMEB) of National Medical Commission (NMC) on the above subject matter being self explanatory interalia imposing a monetary penalty of Rupees One Crore each, on 07 (seven) medical colleges, in view of violations of relevant provisions of NMC regulations and the Hon'ble Court orders in the cases of State of Uttar Pradesh & Ors. vs. Miss Bhavna Tiwari & Ors (SLP (C) No. 9298 of 2018), and the Abhishek Yadav & Ors vs. Army College of Medical Sciences & Ors (WPC No. 730 of 2022)."
