Doctor Accused of Issuing Fraudulent Medical Certificates, Gujarat HC orders probe
Ahmedabad: The Gujarat High Court has recently ordered a police investigation against a doctor who has been accused of issuing fraudulent medical certificates to prisoners to help them get bail.
Further, the HC bench comprising Justice MK Thakkar has observed that while the doctor had an MBBS degree, he had issued a certificate for surgery, which he was not qualified to perform. The previous instances where the doctor had issued such fake certificates using the names of various hospitals was also noted by the court.
“Prima facie, it appears that the doctor, Mahendra L Patel, has been issuing these bogus certificates in the name of different hospitals with different addresses. Let the certificate issued by Dr Patel be verified and examined by the concerned Investigating Officer under the supervision of the Commissioner of Police, Surat, so that the facts can be revealed,” the bench mentioned in the order.
While ordering the police investigation, the High Court bench also reprimanded the lawyer who represented the prisoner seeking relief on the basis of such a fraudulent certificate.
Ultimately, the concerned lawyer was let off from the case. However, the bench denied his request for withdrawing the petition. On the basis of the High Court order, now the investigation regarding the matter will be supervised by the Surat Police Commissioner. The matter has been listed for further hearing on June 8. The doctor is facing two criminal cases.
As per the latest media report by Ahmedabad Mirror, the bench was considering two temporary bail applications on the ground of medical treatment. It was discovered that a medical certificate from Dreamz Multi Speciality Hospital had the name of the concerned Dr. Patel, while his name and stamp were also in another certificate from Shree Hari Multi Speciality Hospital. The doctor has an MBBS and MRSM (UK) degree.
Referring to a trial court order dated May 22, the HC bench questioned the certificate issued by Dreamz Multi Speciality Hospital and also the degrees of the doctor including Member of the Royal Society of Medicine in the United Kingdom. Previously, the trial court had noted that MRSM is not a degree and that the doctor must have membership in that institute.
