Panaji: A Doctor who has been booked under criminal intimidation of police personnel, while seeking the Bombay High Court to quash the FIR, made an offer to donate 25 raincoats and 25 umbrellas of good quality for use by police personnel and their family and to pay Rs 50,000 to the Goa police welfare society. 

The offer was made while the doctor was seeking the quashing of the FIR filed against him. The FIR was filed during the period of all-India lockdown when a police sub-inspector (PSI) on nakabandi duty at Dolphin Circle, Calangute, on March 27, 2020, had stopped the Mercedes Benz driven by the petitioner. The doctor had in turn threatened the police official, reports the Times of India.

The counsel representing the petitioner, Vibhav Amonkar gave an apology for the misunderstanding and made an offer to transfer the money and provide the raincoats and umbrellas within one week. 

The high court while quashing the FIR, observed that in the complaint of the PSI, there is absolutely nothing to show that the petitioner either assaulted the PSI or used criminal force to prevent him from discharging his official duty or that he had threatened the complainant with injury to his person, reputation or property.

Stating that a threat must be with the intention to cause alarm to the complainant to cause that person to do or omit to do any work, the court observed, "Mere expression of any words without any intention to cause alarm would not be sufficient to bring in the application of this section."

Thus, the court noted that no offence can be made out against the petitioner herein under Section 506 of the Indian Penal Code. Meanwhile, the court pointed out that the petitioner's apology and donations have no connection with the quashing of the FIR at Calangute police station.
